Accordingly, we kindly ask that you consider the following while participating at our auction “HCT BID??. 1. As a policy adopted by the Hitachi Construction Machinery Group, we will not sell a Hitachi used excavators (including a mini-shovel of less than 6 tons) with 3,000 hours or less on its hour meter to any part of the Americas. 2. U.S. Customs may not permit the importation of ZAXIS (ZX) brand used Hitachi excavators (including mini-shovels of less than 6 tons) into the United States, pursuant to the laws of the United States of America. HCMJ reserves the right to cancel the acceptance and sales contract on winning or successful bids for Exhibits that are discovered to correspond with either of the stipulations described above. * Radioactivity Reports on Exhibited Auction Machinery -------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Extensive radiation inspections have been conducted internally by Hitachi Construction Machinery Japan Co., Ltd., and by a government licensed 3rd party specialist, on machinery to be exhibited in our Auctions (excluding Parts). Exhibits have been certified to be at, or below the limit of 0.3 µSv/h set by Japan's Port Authority, prior to our Auction. Please be advised that readings for each unit may vary, and in certain cases exceed the 0.3µSv/h limit after leaving HCMJ's premises, or passing beyond HCMJ's control. Inspection reports issued by a public inspection agency may be obtained at an expense of JPY 1,000 per copy, per unit, should it be required for machinery exportation or otherwise. *HCMJ shall not be held liable for any actions or restrictions related to the radioactivity levels or importation criteria of machinery by the intended country of importation. For all related information and to obtain copies of the radioactivity inspection reports, please contact staff members of our Sales department. * Specification Changes on Exhibited Machines -------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Please be advised that the following specifications changes will be performed on exhibited machines sold at HCT BID. Related modifications that have not already been performed on exhibited machines at the time of an auction will undergo the process post sale. Please note that the availability of parts and service may cause certain delays in shipment and/ or pick up schedules. 1. MCR for EX (KX/FX)100-2/ 120-2/ 200-2/220-2 EX100-2/ 120-2/ 200-2 Exhibits will be modified to include a MCR, improving the operational reliability of these machines. The MCR provides hydraulic control of the pump regulator, replacing the standard electronic system. A MCR sticker will be affixed to the machine before shipment. 2. PME for EX (KX/FX)100-3/ 120-3/ 200-3 /220-3 EX200-3 Exhibits will undergo a PME procedure, improving the operational reliability of these machines. Standard electrical components and accessories will be replaced with more durable ones. Exhibits in our auction list containing “PME?? in its specifications, have already had these preventive measures applied. 3. HRV for all excavators equipped with crane Excavator Exhibits that have the Crane specification, were designed for domestic usage and do not fully comply with regulations overseas. Excavators Exhibits to be shipped overseas will have the hook removed from the front attachment. Exhibits that have or will undergo this procedure are listed in the auction list with the “HRV?? specification. 4. Superior Fuel Delivery:S Edition for Zaxis-3 excavators Since 2006, hydraulic excavators equipped with diesel engines conforming to European Emission Standards ?, have experienced complications in areas where improper fuel is being used or inappropriately managed on the job site. HCMJ has improved the fuel delivery system and developed our exclusive “S Edition??, enhancing the quality and performance of used Zaxis-3 excavators destined for overseas export. 5. Super Tropical Cover for Zaxis-200-3/ ZX200LC-3/ ZX210K-3/ ZX210LCK-3 To ensure that the machine maintains the ideal heat balance, super tropical covers will be installed to ZAXIS 200-3 models exported to Middle East, Africa and Asia. * Inhibition of Undue Resale and Diversion -------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Buyers represent and warrant that they will not use any products, software and/or technology relating thereto provided by Hitachi Construction Machinery Japan Co., Ltd. To them under this contract, and any other products, software and/or technology manufactured or developed, by using them (hereinafter called, “Products??) for the purposes of disturbing international peace and security, including (i) the design, development, production, stockpiling or any use of weapons of mass destruction such as nuclear, chemical or biological weapons or missiles, (ii) the other military activities, or (iii) any use supporting these activities. Buyers also represent and warrant that they will not sell, export, dispose of, license, rent, transfer, disclose or otherwise provide the Products to any third party, whether directly or indirectly with the knowledge or reason to believe that the third party or any other party will engage in the activities described above. Buyers assure that they will obtain these same representations and warranties from any third party to whom buyer sells, exports, disposes of, licenses, rents, transfers, discloses or otherwise provides the Products. Furthermore, buyers assure that they will not directly or indirectly, export, re-export transship or otherwise transfer the Products in violation of any applicable export control laws and regulations promulgated and administered by the governments of the countries asserting jurisdiction over the parties or transactions. Buyers agree to indemnify and hold harmless HCMJ against any and all losses, costs or expenses (including reasonable attorneys?? fees) that result from successful Bidders?? failure to comply with Article 15 of Rules of Participation for HCT BID. * Communication Terminals equipped to Hitachi Used Machinery ---------------------------------------------------------------------------- Please be advised that HCMJ will put up the Hitachi used machinery for HCT BID only after removing all communication terminals, from the Hitachi used machinery, which are determined to be removed by HCMJ, including, but not limited to satellite communication terminals, terrestrial communication terminals and general-purpose communication terminals (“Communication Terminals??). Even though the Hitachi used machinery is put up for HCT BID with Communication Terminals, HCMJ will deliver the used machinery to the successful bidder only after removing such Communication Terminals from the Hitachi used machinery by HCMJ as well. * Inland Transportation of Heavy Machinery -------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Please be advised that HCMJ is obligated to arrange inland transportation in accordance to all conditions stipulated by Japan’s transport laws and regulations. This includes the necessary arrangement of authorized routes, escort/ pilot vehicles, etc. - Customers arranging their own transportation are kindly reminded to arrange for appropriate road tracking vehicles to pick up heavy equipment. - HCMJ will arrange appropriate road tracking vehicles in accordance with the weight and dimensions of heavy equipment. - HCMJ may disassemble machinery should its weight and dimensions exceed Japan’s transportation regulations, or the load capacity of the transport vehicle. - HCMJ will charge customers for all assembly, disassembly, and inland costs associated to the transportation of machinery. * European Fluorinated Greenhouse Gases (F-gas) Regulation (517/2014) -------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- This is to inform you that, so as to control amount and importation of Fluorinated Greenhouse Gases (F-gas), New European F-gas Regulation (517/2014) (the “F-gas Regulation??) has become applicable to construction machinery equipped with air conditioner pre-charged with F-gas (the “Machine??) from January 1st, 2017. Hence, those who intend to import the Machine into European Economic Area (EEA) shall, on their own responsibility, comply with F-gas Regulation as follows: 1. The importer of the Machine into EEA (the “Importer??) shall have its authorization to use the quota pursuant to the F-gas Regulation. 2. The import of the F-gas into EEA without the authorization shall cause violation of F-gas Regulation. If the Importer does not have the authorization, a) the Machine shall be sold outside EEA to those who have the authorization by themselves, or b) F-gas shall be removed from the Machine outside EEA. In this case, F-gas available at the EEA market could be recharged after importation into EEA. * Overseas Sales on Hitachi ZH200-A(Used) -------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Please be advised that this machine is a Japanese Domestic model. It has been manufactured in accordance with the standards and requirements of Japan.
