Special Terms
1. Cash, Certified or cashiers check. All purchases to be paid for before buyers leaves the premises to guarantee your purchases.
2. Sales tax will be added to taxable items unless you hold a valid California resale permit and is on file with Nelson Auctions.
3. No item may be removed from the premises without payment in full.
4. All purchases must be removed from the premises not later than the announced time and date, or they will be forfeited.
5. Cost and responsibility of removal of purchases remains solely with the purchaser.
6. Everything SOLD AS IS WHERE IS, WITH NO GUARANTEE EITHER WRITTEN OR IMPLIED.
7. While descriptions are believed to be correct there are no guarantees. It is the Buyers sole responsibility to inspect and verify any and all information provided by the Auctioneer and or his agents, either written or verbally including but not limited to Make, Model, Year, Serial Number and Condition.
8. The auctioneer is acting as an agent only, and is not responsible for the acts of its principals.
9. Any misunderstandings or disputes in the bidding will be settled by the Auctioneer. The Auctioneer reserves the right to combine or spilt lots as he sees fit. The auctioneer and only the auctioneer shall determine the bid increment of the sale of each item, and he may at his discretion increase or decrease the bid increment. The auctioneer also reserves the right to refuse to accept a lesser bid than he is currently asking for, on any item being sold.
10. The Seller, Auctioneer and or Auction Company disclaims liability for any injury or damage to any person or property resulting from any cause whatsoever occurring in or about or appurtenant to be the area or premises whereon said sale is being held. All persons entering the sale site do so at their own risk.
11. It is the sole responsibility of the buyer to determine what safety equipment must be in service in all machinery or vehicle purchased from the Auction Co. prior to moving or using it.
12. I UNDERSTAND AND AGREE THAT ON ANY VEHICLE PURCHASE, I AS BUYER AM SOLEY RESPONSIBLE FOR ANY AND ALL APPLICABLE DMV FEES AND/OR ANY SMOG COMPLIANCE.
13. I agree all sales are final and there are NO REFUNDS, NO WARRANTIES, NO EXCHANGES AND NO EXCEPTIONS.
14. The auctioneer may include or delete items to be sold prior to the sale item without notice to buyers, any such insertion or deletion shall not nullify any purchase.
15. AS BUYER I HEREBY AGREE TO PAY FOR ALL ITEMS PURCHASED AND STATE I HAVE INSPECTED EACH ITEM PRIOR TO SALE AND I AM AWARE OF ANY FAULTS THAT MAY EXIST. ANY FAULTS THAT MAY EXIST SHALL NOT NULLIFY ITS SALE. I ALSO AGREE NOT TO STOP PAYMENT ON ANY CHECK AND IN THE EVENT I FAIL TO PAY FOR ANY ITEM OR STOP PAYMENT I AGREE TO PAY STORAGE FEES OF $15.00 PER DAY PER ITEM. TRANSPORTATION FEES TO ANOTHER SALE SITE AT THE PREVAILING RATE AND A SALES COMMISSION OF 15% OF THE GROSS SELLING PRICE, AND ANY LOSS DUE TO A LESSER PRICE OF RESELLING THE ITEM, AS WEELL AS ANY AND ALL ATTORNEY AND COURT COST
